NOTICE OF ADOPTION OF CITY OF HOLDENVILLE ORDINANCE #621 ON NOVEMBER 7, 2006

TAKE NOTICE that the City Council of the City of Holdenville, meeting in regular session on November 7, 2006, adopted ordinance #621 also known as “Grease Trap” ordinance. The ordinance is effective 30 days from first publication of this summary notice as to new facilities. It is mandatory as to existing facilities after one (1) year from date of first publication. The term “facility” is limited to schools, hospitals and nursing homes. A copy of the new “grease trap” ordinance is available for public inspection at the City Clerk’s office during regular business hours. Due to its technical and voluminous material this summary has been submitted for the complete ordinance, as permitted by law.

The new Chapter 12 in Title 4 is Section 4-12-1 though Section 4-12-16. It also applies to wastewater transporters from the pretreatment facilities (schools, hospitals and nursing homes). An underground grease interceptor with a 500-gallon minimum storage capacity is required. (A higher minimum capacity may be determined under this ordinance as to a particular user). FOG(s) means fats, oil and grease. Grease transporter means any persons, firm or corporation engaged in the business of cleaning grease interceptors and transporting such waste.

The ordinance has a permitting process, duty to comply, duty to mitigate upon non-compliance, fines, penalties, surcharge fees and costs for non-compliance and permit termination reasons. The facility permit holder shall properly comply, periodically maintain and keep records of same with a monitor procedure for the City to inspect and sample. Grease Transporters shall maintain an annual permit with a compliance procedure which includes manifest being retained for three (3) years.
